Federal Energy Regulatory Commission (FERC) and Other Regulatory Agencies
Construction of interstate pipeline facilities is regulated under the Natural Gas Act, and the rules and regulations of the Federal Energy Regulatory Commission (FERC). All interstate pipeline construction projects must be approved by the FERC prior to construction. In early 2005, Transwestern met with potential customers to negotiate agreements that would support the building of a new pipeline into the Phoenix, Arizona area. Transwestern filed its construction application with the FERC on September 15, 2006, in Docket No. CP06-459-000 and received its FERC Order authorizing construction of its Phoenix Expansion Project on November 15, 2007.
In addition to the FERC regulations and construction Order issued for its Phoenix Expansion Project, Transwestern has consulted with other Federal, state, tribal, and local regulatory agencies and has received permits when applicable, including, but not limited to, from the following agencies:

The potential environmental impacts of Transwestern’s proposed Phoenix Expansion Project were evaluated in the draft and final EIS to satisfy the requirements of the National Environmental Policy Act. The U.S. Department of the Interior, Bureau of Land Management; the U.S. Department of Agriculture, Forest Service; the U.S. Department of Transportation, Office of Pipeline Safety; the U.S. Department of the Interior, Bureau of Indian Affairs; and the Navajo Nation served as cooperating agencies in the preparation of the draft and final EIS. The final EIS analyzed the environmental impacts of Transwestern’s proposed expansion project, addressing issues related to project objectives; purpose and need; alternatives; geology (including paleontological resources); soils; groundwater; surface waters; wetlands; vegetation; wildlife and aquatic resources; special status species; land use, recreation, public interest areas, and visual resources; socioeconomics (including transportation and traffic and environmental justice); cultural resources; air quality; noise; reliability; safety; and cumulative impacts. The draft and final EIS were mailed to federal, state, and local government agencies; elected officials; Native American tribes; local libraries and newspapers; intervenors; and other interested parties (i.e., affected landowners, miscellaneous individuals, and environmental groups).
